Discrimination At Work: Burness Paull LLP

One of the segments in Morag Hutchison’s talk last week was regarding Discrimination At Work. This covered a range of examples, including Religious; Age; Sex; Disability and Indirect Discrimination.
Morag discussed cases where employees had been dismissed for wearing a headscarf at work, in keeping with their faith. One such cases included an employee who was dismissed on the grounds that a customer had complained about the headscarf. This is a clear example of religious discrimination.
Another example was an incredibly interesting case of religious discrimination. A woman, who was a teacher at a local school, refused to divorce her husband who was found guilty of possessing indecent images of children. The school board sacked her, and she took them to a tribunal on the grounds that her religious beliefs on the sanctity of marriage were being discriminated against.
Morag also touched on the now infamous case against Price Waterhouse Cooper, where a secretary took her employment agency to court for disciplining her for not wearing high heels.
There were lots of very interesting examples that featured in the news – or were completely new to the audience – that were difficult and intricate in terms of direct / indirect discrimination.
